## Terms of Service
### 1. Service Description
AllureAI is a Discord bot that provides private AI chat threads, voice calls, media generation, and optional tabletop-style gameplay features. The service is provided on an "as-is" and "as-available" basis without any guarantees of availability, performance, or functionality.
### 2. Eligibility and Account Responsibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use this service.
- You must comply with Discord's Terms of Service and any applicable local, state, and federal laws.
- You are solely responsible for maintaining the security of your Discord account and any linked payment methods.
- You are responsible for all activities that occur under your account, whether authorized by you or not.
### 3. Acceptable Use
Prohibited activities include, but are not limited to:
- Harassment, hate speech, threats, or content that violates Discord's policies
- Attempting to exploit the service, bypass rate limits, abuse billing/credits, or engage in fraud
- Reverse engineering, decompiling, or attempting to extract the bot's source code or algorithms
- Using automated tools, scripts, or bots to interact with AllureAI (except as explicitly permitted)
- Sharing account credentials or attempting to access another user's account
- Using the service for any illegal purpose or to facilitate illegal activities
- Violating intellectual property rights of AllureAI or third parties
Violation of these terms may result in immediate termination of your access without notice or refund.
### 4. Payments, Credits, and Refund Policy
#### 4.1 No Refunds
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL SALES ARE FINAL AND NON-REFUNDABLE, including but not limited to:
- Service downtime, outages, or technical issues
- Dissatisfaction with AI outputs, quality, or functionality
- Accidental purchases or duplicate transactions
- Account suspension or termination (whether by you or us)
- Changes to service features, pricing, or availability
- Third-party payment processor errors or delays
- Webhook failures or delayed credit grants (see 4.2)
#### 4.2 Credits and Subscriptions
- Credits are virtual currency used to access certain features (LLM usage, voice calls, media generation, D&D chapter generation, etc.).
- Credits have no cash value and cannot be transferred, sold, or exchanged for money.
- Credits do not expire unless explicitly stated, but we reserve the right to modify expiration policies with 30 days' notice.
- Purchases are processed by third-party providers (e.g., Ko-fi). We are not responsible for payment processor errors, delays, or failures.
- Credit grants are best-effort only. If a webhook fails or credits are not applied, you must contact support with your transaction ID within 30 days. We will investigate in good faith but make no guarantees of credit recovery.
- Subscription renewals are automatic unless cancelled through the payment provider (Ko-fi). Cancellations do not entitle you to refunds for unused portions of the current billing period.
- We reserve the right to modify credit costs, subscription pricing, or feature availability at any time with reasonable notice.
#### 4.3 Chargebacks and Payment Disputes
- Initiating a chargeback or payment dispute may result in immediate account suspension or termination.
- If a chargeback is reversed in our favor, you remain responsible for the original payment amount plus any fees we incur.
### 5. Disclaimers and Warranties
#### 5.1 No Warranties
THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the service will be uninterrupted, error-free, secure, or free from viruses or harmful components
- Warranties regarding the accuracy, reliability, or quality of AI-generated content
- Warranties that defects will be corrected or that the service will meet your requirements
#### 5.2 AI Output Disclaimers
- AI-generated content may be incorrect, inappropriate, offensive, or nonsensical. You acknowledge that AI outputs are generated by third-party models and are not reviewed or endorsed by us.
- Do not rely on AI outputs for medical, legal, financial, or professional advice. All AI content is for entertainment purposes only.
- We do not guarantee that AI outputs will be consistent, accurate, or suitable for your intended use.
- You are solely responsible for how you use, interpret, or act upon AI-generated content.
#### 5.3 Third-Party Services
- The service relies on third-party providers (Discord, OpenAI, ElevenLabs, Groq, MongoDB, etc.). We are not responsible for their availability, performance, or policy changes.
- Service interruptions may occur due to third-party outages, API changes, or rate limiting, and we assume no liability for such interruptions.
### 6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALLUREAI, ITS OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:
- Loss of profits, revenue, data, or business opportunities
- Loss of credits, subscriptions, or virtual currency
- Costs of substitute services
- Personal injury or property damage
- Emotional distress or mental anguish
- Any damages arising from your use or inability to use the service
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS LESS.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.
### 7. Indemnification
You agree to indemnify, defend, and hold harmless AllureAI, its operators, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the service

- Your violation of any third-party rights (including Discord's Terms or intellectual property rights)
- Any content you submit, post, or transmit through the service
### 8. Termination
#### 8.1 Termination by You
- You may stop using the service at any time by ceasing to interact with the bot.
- Cancelling a subscription through the payment provider does not entitle you to refunds for unused portions.
#### 8.2 Termination by Us
We reserve the right to suspend or terminate your access to the service immediately, without notice or refund, for any reason, including but not limited to:
- Violation of these Terms of Service or Discord's policies
- Fraudulent, abusive, or illegal activity
- Non-payment or payment disputes
- Request by law enforcement or regulatory authorities
- Service discontinuation or business closure
#### 8.3 Effect of Termination
- Upon termination, your access to the service will cease immediately.
- Credits, subscriptions, and virtual currency are forfeited upon termination and are non-refundable.
- We may delete or retain your data in accordance with our Privacy Policy.
- Sections 5 (Disclaimers), 6 (Limitation of Liability), 7 (Indemnification), and 9 (General Provisions) survive termination.
### 9. General Provisions
#### 9.1 Changes to Terms
- We reserve the right to modify these Terms at any time. Material changes will be communicated via Discord or our official channels with reasonable notice.
- Continued use of the service after changes constitutes acceptance of the modified Terms.
- If you do not agree to the modified Terms, you must stop using the service immediately.
#### 9.2 Governing Law and Dispute Resolution
- These Terms are governed by the laws of the jurisdiction in which AllureAI is operated, without regard to conflict-of-law principles.
- Where permitted by law, disputes arising from these Terms or the service will be resolved on an individual basis and not as a class, consolidated, or representative action.
- If arbitration is permitted and elected, it will be conducted on an individual basis in a location reasonably convenient to the parties and under commercially reasonable procedures.
#### 9.3 Severability
- If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

## Privacy Policy
### 1. Information We Collect

- Discord identifiers: User ID, server ID, channel/thread IDs, message IDs
- Usage data: Commands used, features accessed, timestamps, session durations
- Technical data: IP addresses (via Discord), device information, connection metadata
#### 1.2 User-Provided Information
- Profile information: Name, pronouns, bio, timezone (if provided via `/profile_set`)
- Billing linkage: Email address (if you choose to link for Ko-fi guest checkout), subscription tier metadata, webhook transaction IDs, payment provider identifiers

- Data provided by Discord (user profile, server membership, permissions)
- Data from payment processors (Ko-fi) regarding transactions and subscriptions
### 2. How We Use Your Information
We use collected information to:
- Provide the service: Generate AI replies, manage chat/voice sessions, apply credits and subscriptions, maintain continuity across interactions
- Prevent fraud and abuse: Detect and prevent fraudulent transactions, rate limit enforcement, account security
- Improve the service: Analyze usage patterns, debug issues, optimize performance (aggregated/anonymized data)
- Comply with legal obligations: Respond to legal requests, enforce our Terms of Service
### 3. Data Sharing and Third-Party Services
#### 3.1 Third-Party Processors
Your data may be processed by:
- LLM providers (OpenAI, Groq): Messages and context are sent to generate responses. These providers have their own privacy policies and data retention practices.
- Voice providers (ElevenLabs): Audio and text are processed for TTS/STT. Audio may be temporarily stored on their servers.
- Vector database providers (Pinecone, or local storage): Message embeddings and memory vectors are stored for context retrieval.
- Payment processors (Ko-fi): Transaction data, email addresses, and subscription information are processed according to Ko-fi's privacy policy.
- Infrastructure providers (MongoDB, hosting services): Data is stored on their servers in accordance with their security practices.
#### 3.2 Data Sharing Limits
- We do not sell your personal information to third parties.
- We may share aggregated, anonymized usage statistics for business purposes.
- We may disclose information if required by law, court order, or to protect our rights and safety.
### 4. Data Storage and Security
#### 4.1 Storage Locations
- Primary storage: MongoDB (cloud-hosted, location depends on provider configuration)
- Backup storage: May be stored in additional locations for redundancy

- We implement reasonable security measures to protect your data, including encryption in transit and access controls.
- However, no method of transmission or storage is 100% secure. You acknowledge that data transmission over the internet carries inherent risks.
#### 4.3 Data Breaches
- In the event of a data breach that may affect your personal information, we will notify affected users and relevant authorities as required by applicable law.
- We assume no liability for breaches caused by third-party providers or factors beyond our reasonable control.
### 5. Data Retention
#### 5.1 Retention Periods
- Message logs and chat history: Generally retained for up to 90 days after your last interaction. We may retain limited records for longer where reasonably necessary for security, fraud prevention, dispute resolution, or legal compliance, or where deletion is not technically feasible immediately (see 6.2).
- Billing and transaction records: Retained for 7 years or as required by law for tax/accounting purposes
- Account data: Retained while your account is active and for 30 days after account termination
- Voice audio: Processed in real-time and not permanently stored; temporary transcription data may be retained for up to 7 days
#### 5.2 Deletion
- Upon account termination or deletion request, we will delete or anonymize your data within a reasonable period (generally within 30 days), except where retention is required by law, necessary for security/fraud prevention, billing records, or other legitimate operational purposes.
### 6. Your Rights and Controls
#### 6.1 Access and Correction
- You can view your profile data via `/profile_show`
- You can update your profile data via `/profile_set`
- You can request a copy of your data by contacting support via `/support`
#### 6.2 Deletion Requests
- You can request deletion of your data via `/support`. We will process requests within 30 days, subject to legal and operational requirements.
- Note: Deletion may result in loss of credits, subscriptions, and chat history. Deleted data cannot be recovered.
#### 6.3 Opt-Out Controls
- Opt out of re-engagement DMs via `/opt_out_pings`
- Opt out of upsell messages via `/opt_out_upsells`
- Note: Opting out does not affect service functionality or data collection necessary for service operation.
#### 6.4 Limitations
- Some data may be retained if required by law, for fraud prevention, or to fulfill contractual obligations (e.g., billing records).
- Deletion requests do not affect data already shared with third-party processors (LLM providers, etc.), which is subject to their own retention policies.
### 7. Children's Privacy
- The service is intended for users 18 years of age or older. We do not knowingly collect information from minors.
- If we become aware that we have collected information from a minor, we will delete it promptly.
### 8. International Data Transfers
- Your data may be transferred to and processed in countries other than your country of residence, including the United States and other jurisdictions where our service providers operate.

- You represent and warrant that your content does not violate any third-party rights (including intellectual property, privacy, or publicity rights) and complies with all applicable laws and Discord's Terms of Service.
#### 1.2 Prohibited Content
You may not use the service to create, generate, or facilitate content that:
- Violates Discord's Terms of Service or Community Guidelines
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Constitutes hate speech, discrimination, or incites violence
- Depicts or promotes illegal activities, including but not limited to: child exploitation, non-consensual content, or content that violates age-restriction laws
- Infringes on intellectual property rights (copyright, trademark, etc.)
- Contains malware, viruses, or attempts to exploit security vulnerabilities
- Impersonates another person, entity, or misrepresents your affiliation
- Spams, scams, or attempts to phish other users
### 2. Content Standards
#### 2.1 Age Restrictions
- You must comply with Discord’s age requirements and all applicable laws.
#### 2.2 Server-Specific Rules
- Server operators may restrict or prohibit certain kinds of content in public channels.
- You must comply with server-specific rules and moderation decisions.
- We are not responsible for server-specific content policies or enforcement actions taken by server moderators.
#### 2.3 Legal Compliance
- You are responsible for ensuring that any content you create or request complies with applicable laws in your jurisdiction.
- We reserve the right to refuse service or remove content that we determine, in our sole discretion, violates applicable laws or our policies.
### 3. AI-Generated Content
#### 3.1 No Guarantees
- AI-generated content is created by third-party models and is not reviewed, edited, or endorsed by us.
- We do not guarantee the accuracy, appropriateness, quality, or suitability of AI-generated content.
- AI outputs may be incorrect, offensive, nonsensical, or inconsistent.
#### 3.2 Content Ownership
- AllureAI owns the creations you make using the service, including (without limitation) characters, campaigns, novels, prompts, configurations, and other creator content, whether created by you, generated by AI at your request, or created through a combination of both.
- By submitting or publishing creator content, you assign to AllureAI all right, title, and interest in and to that creator content, including all intellectual property rights, to the maximum extent permitted by law. Where an assignment is not permitted or effective, you grant AllureAI a perpetual, worldwide, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works from such content for any purpose related to operating, improving, promoting, and providing the service.
- You may use your published and unpublished creations for personal, non-commercial use, provided you do not represent them as official statements of AllureAI and you comply with these policies and Discord’s policies.
- Creator rewards/benefits (if any) are optional and may be added, changed, or removed at any time at AllureAI’s sole discretion. AllureAI has no obligation to provide compensation, payouts, revenue share, or rewards for any creator content.
#### 3.3 Content Moderation
- We reserve the right, but not the obligation, to monitor, review, or remove content that we determine, in our sole discretion, violates these policies or applicable laws.
- We may use automated systems or manual review to detect and address policy violations.
- We assume no liability for content that we fail to detect or remove.
### 4. Intellectual Property
#### 4.1 Your Content
- By submitting content to the service, you acknowledge and agree that creator content ownership is governed by Section 3.2 above. In addition, to the extent any rights are not assigned, you grant AllureAI the license described in Section 3.2.
- We may retain and continue to use content as necessary to operate and improve the service, to comply with legal obligations, and to enforce these policies, even after you delete content or your account (subject to the Privacy Policy).

- The AllureAI bot, its code, branding, documentation, and proprietary algorithms are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, or create derivative works based on our proprietary content without explicit written permission.
#### 4.3 Third-Party Content
- Characters, images, and other content may be created by third parties (users or external sources).
- We respect intellectual property rights and will respond to valid DMCA takedown requests in accordance with applicable law.
- You are responsible for ensuring that any content you use (including character cards, images, or prompts) does not infringe on third-party rights.
### 5. Reporting and Enforcement
#### 5.1 Reporting Violations
- Users can report policy violations, abuse, or illegal content via `/feedback` or `/support`.
- Reports should include: description of the violation, relevant message/channel IDs, screenshots (if applicable), and any other relevant information.
#### 5.2 Enforcement Actions
- We reserve the right to take any enforcement action we deem appropriate, including but not limited to:
- Warning users
- Removing content
- Suspending or terminating accounts
- Reporting violations to Discord or law enforcement

- We are not responsible for user-generated content or AI-generated content. The service is a platform that facilitates interactions; we do not endorse, review, or control the content created by users or AI models.
- You use the service at your own risk. You are solely responsible for how you use, interpret, or act upon any content generated or accessed through the service.
